Statutory Instrument

The 2025/26 rates were set by the Employment Rights (Increase of Limits) Order 2025 (SI 2025/295), made under ERA 1996 s.227. The Order came into force on 6 April 2025.

If your termination straddled the 6 April 2026 line

A termination on 5 April 2026 uses the £719 cap. A termination on 6 April 2026 or later uses £751. The date of the at-risk letter, the notice date, and the date you sign a settlement agreement do not affect this; only the effective date of dismissal counts.

Backdated claims from 2025/26

You have 6 months from the relevant date to claim statutory redundancy pay under ERA 1996 s.164. A termination in October 2025 has a claim window to April 2026; a March 2026 termination has a claim window to September 2026. The tribunal can extend by up to 6 months on a just-and-equitable basis but rarely does.
