Statutory basis
The governing instrument is the ERO (NI) 1996. It uses the same 0.5 / 1.0 / 1.5 weeks-per-year age-band structure as ERA 1996 s.162, but the week's pay cap is set separately by the Department for the Economy. For 2026/27 the NI cap is £783 a week (uprated from £749 by 4.5% under the Employment Rights (Increase of Limits) Order (NI) 2026), giving a maximum statutory payment of £23,490. That is higher than the £751 / £22,530 that applies in Great Britain.

If your employer is insolvent in NI
In Great Britain you claim from the National Insurance Fund via the Insolvency Service. In Northern Ireland the equivalent route is the Department for the Economy (NI) using the RP1 form. The weekly cap on payments from the fund is the NI statutory figure of £783.
