Am I eligible for statutory redundancy pay?

Eight questions, in order. If you reach the end and have not been excluded, you qualify for the statutory amount calculated on the homepage.
1. Are you classified as an employee (not a worker or self-employed)?

Yes: Continue to Q2.

No: You do not qualify for statutory redundancy. Workers and self-employed are excluded. Check whether you are misclassified.

2. Do you have at least 2 years of continuous employment with this employer?

Yes: Continue to Q3.

No: You do not qualify. There is no entitlement under 2 years. Check whether you are unfairly dismissed on grounds without a qualifying period (e.g. discrimination, whistleblowing).

3. Has your employer dismissed you (not you resigning)?

Yes: Continue to Q4.

No: A genuine voluntary resignation excludes you. Voluntary redundancy in a redundancy round is treated as a dismissal and still qualifies; check the situation page on voluntary offers.

4. Is the reason for dismissal genuine redundancy (business closing, site closing, work reducing)?

Yes: Continue to Q5.

No: If the reason is misconduct, performance or some other substantial reason, statutory redundancy does not apply. Unfair dismissal may still be claimable.

5. Has the employer offered you a suitable alternative role that you refused?

Yes: If your refusal was reasonable, continue to Q6. If unreasonable, you forfeit statutory redundancy.

No: Continue to Q6.

6. Are you within the 6-month claim window from the termination date?

Yes: Continue to Q7.

No: Late claims depend on the tribunal granting a just-and-equitable extension (up to a further 6 months). Take advice now.

7. Have you been paid the correct statutory amount?

Yes: No further action. Keep records of the payslip and breakdown.

No: Raise it in writing with the employer first. Then ACAS Early Conciliation. Then a tribunal claim.

8. Is your employer insolvent and unable to pay?

Yes: Claim from the National Insurance Fund via the RP1 form. The Secretary of State steps in.

No: If the employer is solvent and refuses to pay, file an ET1 claim within the 6-month window.
