Statutory Instrument

The 2024/25 rates were set by the Employment Rights (Increase of Limits) Order 2024 (SI 2024/322), made under ERA 1996 s.227. The Order came into force on 6 April 2024.

RPI driver

The 2024/25 uprating from £643 to £700 was an 8.9% increase, matching the September 2023 Retail Prices Index (RPI) figure of 8.9% with no discretionary topping-up. RPI, not CPI, is the statutory index under section 34 of the Employment Relations Act 1999 (CPI for September 2023 was 6.7%). The 2025/26 uprating to £719 (2.7%) tracked the lower September 2024 RPI figure of 2.7%.

Backdated 2024/25 claims

The statutory 6-month claim window from a 2024/25 termination has now generally closed. A late claim depends on the tribunal's discretion under ERA 1996 s.164, which can extend by up to a further 6 months if just and equitable. Insolvency Service claims via RP1 have a separate, more flexible timetable.
